Probate means the process of “proving” a will, or having it declared valid and effective following the death of the testator.  Probate proceedings are the actual mechanism for the orderly transfer of a deceased persons property, specifically designed to protect those who might have an interest in the property, including heirs, beneficiaries, creditors, and taxing authorities.  The actual administration of the probate is carried out by a personal representative who is appointed pursuant to the Will.  In the event the deceased did not have a Will, then an administrator is appointed by the court to handle the estate of the deceased.

For most clients dealing with the loss of a loved one, the administration of an estate through probate can appear to be a complicated legal maze of deadlines and forms.  Maher Ahrens Foster Shillito has years of experience handling simple small estates up to large complicated estates embroiled in ongoing lawsuits.
